- The information stored on our servers (“Servers”), which may be located in our facilities, at hosted locations (for example, Rackspace), or cloud-based (for example, Amazon Web Services), and owned by us or by a firm from whom we lease resources or subscribe to services.

This policy applies only to information we collect:
- On the Website.
- In the App.
- In email, text, document managers, and other electronic communications sent through or in connection with the App and the Website.
- Through mobile and desktop applications you download from the Website or the Apple or Google Play stores, which provide dedicated non-browser-based interaction between you and this Website.

Children Under the Age of 13

- Information that is about you but individually does not identify you, such as the name of the company (the “Customer”) that uses our services (the “Services”) pursuant to an agreement between the Customer and the Company, such as our WaterCompass, WeatherTRAK, OptiFlow, Basemanager, App Manager, Flow Manager, HydroPoint Performance Management, and HydroPoint 360 services.
- Information that identifies or describes equipment owned or operated by the Customer which is to be used with or tracked by any of our Services, including models, asset names, purchase and installation dates, location, coverage areas, device programming, and images.
- Operational information such as water and utility bills.
- When you use our web store, we request information from you on our order form. To buy from us, you must provide contact information (like name and shipping address) and financial information (like credit card number, expiration date). This information is used for billing purposes and to fill your orders. If we have trouble processing an order, we'll use this information to contact you.
You may also provide information to be published or displayed ("Posted") on public areas of our Websites or transmitted to other users of the Website or third parties ("User Contributions"), for example, comments on blog postings or questions in support forums. Your User Contributions are Posted and transmitted to others at your own risk. Although we limit access to certain pages and you may set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Note, however, that opting out of the App's collection of location information will cause its location-based features to be disabled and may prevent it from providing information required by Customers for whom you are providing services.
Some information we collect automatically is statistical data and may include personal information and we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Website and our App and to deliver a better and more personalized service, including by enabling us to:
- Estimate our audience size and usage patterns.
- Store information about your preferences, allowing us to customize our Website and the App according to your individual interests.
- Speed up your searches.

Log Information

- Provide the Customer you work for and/or your employer with our proprietary scoring information on your use of the Service.
- Provide you with the Website or the App and its contents, and any other information, products or services that you request from us or that we may believe will be of interest to you.
- Fulfill any other purpose for which you provide it.
- Give you notices about your account/subscription, including expiration and renewal notices.
- Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
- Notify you when updates to the Website or the App are available, of changes to any products or services we offer or provide though it, and of products or services which we believe you will find of benefit.
- On an aggregated basis, to provide better service to all of our customers through improved analytics, portfolio- or region-wide analyses and reporting, predictive activities such as maintenance or configuration changes; or to derive performance indices.

- Store information about your preferences, allowing us to customize our Website and the App according to your individual interests.

We use location information we collect to (i) track when a user has visited a Customer site or equipment at a specific time; (ii) see the time that a user has transited between two points; (iii) as required by your employer or the Customer; (iv) to display information that is contextually related to your location (for example, a map showing equipment for a Customer site that you are visiting, or even a photograph of a specific piece of equipment that is near you.
Disclosure of Your Information
We may disclose aggregated information about our users and information that does not identify any individual or device without restriction.
In addition, we may disclose personal information that we collect or that you provide as described in this privacy policy:
- To our subsidiaries and affiliates.
- To our employees involved in activities related to the fulfillment of services provided as part of our Customer agreements, including your use of our Website, App, and Services. This may also include engineering and quality assurance teams who require access to information in development, debugging, or support activities.
- To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of HydroPoint Data Systems Inc.’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by HydroPoint Data Systems, Inc., about our Website and/or App users is among the assets transferred.
- Indirectly, to payment processors when you purchase products or services online or through subscription renewals; we do not retain this information, even if collected through the Website or App forms we display.

- To Customers and their authorized representatives whom you represent and owners of user accounts on our Servers to which you are registered.

- We may share information of other users in other accounts when you are registered to view information on their behalf (for example, if you are a maintainer responsible for multiple Customer sites).

- To enforce our rights arising from any contracts entered into between you and us, including the Mobile Application End-User Agreement, and for billing and collection.
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of HydroPoint Data Systems, Inc., our customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection.
Information on Servers that are hosted by third parties such as Amazon and Rackspace may be further subject to their Privacy Policies and accessible to them.
HydroPoint will never sell your Personal Information to a third party; there is no need for you to “opt-out”.
We will ask for your consent before using information for a purpose other than those that are set out in this Privacy Policy.
Your Choices About Our Collection, Use, and Disclosure of Your Information
We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of over your information.

If you block the use of location information, some parts of the Website or the App may then be inaccessible or not function properly, and information required by Customers you represent will be unable to be provided to them.

If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our target-audience preferences, you can opt-out by email. You can also always adjust your preferences in your account profile where it is maintained, either on our websites or through third-party services we may use (for example, Pardot) or by sending us an email stating your request to support@hydropoint.com or calling us at +1 800 362 8774.
- Sale of Personal Information to a Third Party. HydroPoint will never sell your Personal Information to a third party; there is no need for you to “opt-out”.
Personal Information Retention
We will retain your personal information for as long as is necessary to fulfill the usage purposes stated in this policy, to fulfill legal requirements as appropriate, or as long as permitted by applicable law.
Accessing and Correcting Your Personal Information

You may also send us an email at support@hydropoint.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account, which will result in the immediate termination of services we provide to you. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
If you delete your User Contributions from the Website or the App, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other Website or App users. Proper access and use of information provided on the Website or the App, including User Contributions, is governed by our terms of use. Some information – for example, site surveys or other work performed on behalf of your Customer – may only be deleted by the account holder.
We commit to providing you a record of your Personal Information within thirty (30) days of your verified request, covering the twelve-month period preceding our receipt of your request, at least once during a twelve-month period. You are not required to have an account in order to make a verifiable request.
Data Security
Some of the information you provide may be stored on your computer, your mobile device or on our Servers. We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure Servers behind firewalls. Any personal credit information used in payment transactions is not retained and is stored only, if at all, by the payment processor.

If we make material changes to how we treat our users' personal information, we will post the new privacy policy on this page along with a notice that the privacy policy has been updated and notify you within our Website or the App or online services the first time you use it after we make the change.
